Pending before the Court in this deficiency action is respondent's Motion to Dismiss for Lack of Jurisdiction, filed July 9, 2024. On August 5, 2024, petitioner filed an Objection thereto. On August 29, 2024, respondent filed a Response to Objection to Motion to Dismiss for Lack of Jurisdiction.

Upon due consideration and for cause, it is

ORDERED that respondent's above-referenced Response is recharacterized as respondent's Reply to Objection to Motion to Dismiss for Lack of Jurisdiction. It is further

ORDERED that, on or before September 20, 2024, petitioner shall file a sur-reply, if any, to respondent's Reply to Objection to Motion to Dismiss for Lack of Jurisdiction.
