This case was calendared for an in-person trial at the session of the Court scheduled on Monday, May 2, 2022, in San Diego, California. On April 14, 2022, the Court issued an Order directing the parties to file on or before May 16, 2022, a signed Proposed Stipulated Decision or joint Status Report, continuing this case for trial from the May 2, 2022, San Diego, California, session of the Court and jurisdiction was retained by the undersigned.
On October 3, 2022, the parties filed a Status Report representing therein that a basis for settlement has been reached in this case, however, the preparation of the stipulated decision document has not yet been completed. Additionally in that report, the parties represent that petitioner passed away subsequent to the filing of the petition in this case. Furthermore, the parties are inquiring as to who is handling petitioner's probate in an effort to establish with certainty the individual who is authorized under the relevant law to execute a stipulated decision document in this case. Lastly, in the parties' Status Report filed October 3, 2022, the parties request an additional 60 days to file an appropriate Motion to Correct the Caption as well as a signed Proposed Stipulated Decision or a Status Report.
Upon due consideration, it is
ORDERED that, on or before December 2, 2022, the parties shall file a file an appropriate Motion to Correct the Caption. It is further
ORDERED that, on or before December 2, 2022, the parties shall a signed Proposed Stipulated Decision or a Status Report.
