DECISION & ORDER ON MOTION

Motion by respondent for an extension of time to comply with a decision and order of this court dated February 11, 2013, which determined an appeal from an order of the Civil Court of the City of New York, Queens County, entered April 4, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied as moot.

Respondent's motion to extend the time granted by this court's decision and order dated February 11, 2013 to move to restore the action to the Civil Court's trial calendar is moot, as the Civil Court subsequently restored the action to the trial calendar.
