Pending in the above-docked matter is a Motion for Entry of Decision, filed August 22, 2022, by petitioner herein, and first supplement thereto, filed September 13, 2022. Subsequently, on November 22, 2022, respondent filed a response advising that settlement had been reached and requesting additional time for the parties to submit a Proposed Stipulated Decision.

The premises considered, it is

ORDERED that, on or before January 6, 2023, either (1) respondent shall file with the Court a supplement to the just-referenced response to petitioner's motion, confirming therein respondent's position as to the amount(s) to be included in any decision to be entered in the case and whether petitioner is in agreement with such amount, or, alternatively (2) the parties shall submit a stipulated decision resolving this case and incorporating, if applicable, appropriate language establishing petitioner's entitlement to any overpayment.
