Kathleen Darleen DANIEL, Appellant v. The STATE of Texas, Appellee
From the 216th Judicial District Court, Kendall County, Texas
Trial Court No. 5924, 5925 & 5926
Honorable N. Keith Williams, Judge Presiding
ORDER
Appellant's brief was originally due on January 13, 2017. Appellant's retained counsel, Ms. Angela Moore, has been granted two previous extensions, the latest until March 15, 2017. On March 15, 2017, Ms. Moore filed her third request for an extension. In an order dated March 23, 2017, this court granted Ms. Moore's third request, ordered her to file the brief no later than April 14, 2017, and cautioned Ms. Moore that no further extensions of time would be granted. The brief has not been filed.
Ms. Moore is hereby ORDERED to file appellant's brief no later than May 4, 2017. If Ms. Moore does not file a brief by May 4, 2017, this cause will be abated for the trial court to conduct a hearing to determine whether: (1) appellant desires to prosecute his appeals; (2) appellant has made the necessary arrangements for filing a brief; and (3) counsel has abandoned the appeals. Because sanctions may be necessary, the trial court should make a finding as to whether current counsel abandoned the appeals even if new counsel is retained or substituted before the date of the hearing.
The clerk of this court shall cause a copy of this order to be served on Ms. Moore by certified mail, return receipt requested, and by regular United States mail.
