Decided January 13, 1953

Action for a declaratory judgment holding the sale of alcoholic liquor on premises of the defendants illegal, and for other relief, brought to the Superior Court in Fairfield County and tried to the court, Mellitz, J.; judgment for the plaintiff and appeal by the defendants. Error; judgment directed.

Rocco E. LaCava, with whom, on the brief, was Abram W. Spiro, for the appellee (plaintiff).


The facts in this case are similar to those in Danbury v. Corbett, decided this day, and the identical legal question is presented. The decision in that case impels a like decision in this one.
