Daly v. Daly

Appellate Division of the Supreme Court of New York, Second Department
Dec 10, 1951
279 App. Div. 752 (N.Y. App. Div. 1951)

Opinion

December 10, 1951.

Present — Johnston, Acting P.J., Adel, Sneed, Wenzel and MacCrate, JJ.

In a proceeding to compel appellant to pay for the support of his wife and two children, he appeals from so much of an order of the Domestic Relations Court of the City of New York, Family Court Division, County of Queens, as directs him to pay the sum of $240 a month for the support of the children. Order, insofar as appealed from, modified on the facts by reducing the amount of the award to the sum of $150 a month. As so modified, the order is unanimously affirmed. In our opinion, the award was excessive.
