In a negligence action to recover damages for personal injuries, plaintiff appeals from a judgment of the Supreme Court, Nassau County, entered November 18, 1970, in favor of defendants upon a jury verdict. Judgment affirmed, with costs. No opinion. Hopkins, Acting P.J., Latham, Christ and Brennan, JJ., concur; Benjamin, J., concurs on the strength of Stone v. Bigley Bros. ( 309 N.Y. 132), which, in his view held, on comparable facts, that the question of ad hoc employment was one for the jury.
