Richard R. D'Alessandro Petitioner v. Commissioner of Internal Revenue Respondent

ORDER OF DISMISSAL

CARY DOUGLAS PUGH JUDGE

This case is currently set for trial at the Court's February 28, 2022, San Diego, California trial session. On December 22, 2021, respondent filed a Motion to Dismiss on Grounds of Mootness, advising that petitioner's "tax liabilities for taxable years 2013, 2014, and 2015 are zero and the filed lien has been removed". See Greene-Thapedi v. Commissioner, 126 T.C. 1 (2006). We directed petitioner to file a response by January 28, 2022. On January 31, 2022, respondent filed a Status Report. Attached thereto was a faxed letter from petitioner stating that petitioner "will not be filing…[an objection]" to respondent's motion to dismiss. To date, petitioner has not filed a response with the Court. Upon due consideration and for cause, it is hereby

ORDERED that respondent's Motion to Dismiss on Grounds of Mootness, filed December 22, 2022, is granted, and this case is dismissed as moot.
