DECISION & ORDER ON MOTION

Motion by appellant for an enlargement of time to perfect an appeal from a final judgment of the Civil Court of the City of New York, Queens County, entered August 18, 2011, and to continue so much of a stay granted by decision and order of this court dated September 28, 2011 as stayed execution of the monetary portion of the final judgment.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by April 6, 2012; and it is further,

ORDERED that the branch of the motion seeking to continue so much of the stay granted by decision and order of this court dated September 28, 2011 as stayed execution of the monetary portion of the final judgment is granted on condition that the appeal be perfected by April 6, 2012 and on the further condition that appellant deposit the sum of $4,050, the judgment amount, within 10 days of the date of this decision and order; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
