This case was called and recalled from the calendar of the Court's Mobile, Alabama trial session on February 22, 2023. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and made an Oral Motion to Dismiss for Lack of Prosecution. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that respondent's Oral Motion to Dismiss is taken under advisement. It is further

ORDERED that respondent shall, on or before March 10, 2023, file a written Motion to Dismiss for Lack of Prosecution.
