Judgment and order reversed and new trial granted, with costs to appellant to abide event. Held, that the questions raised by the defendant's counterclaim should have been submitted to the jury. The question of the defendant's counterclaim not being a proper counterclaim, was not raised at the Trial Term. All concur.
