An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about April 17, 2018, and said appeal having been perfected, And plaintiff-respondent having moved to dismiss the aforesaid appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, without prejudice to plaintiff-respondent to raising substantive arguments in the respondent's brief on appeal. Sua sponte, the appeal is adjourned to the January 2020 Term.
