Action to recover for goods sold and delivered and for an accounting. Order denying motion to dismiss the complaint, under rule 106 of the Rules of Civil Practice, on the grounds of insufficiency and that plaintiff does not have legal capacity to sue, affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Carswell, Johnston, Adel and Sneed, JJ., concur.
