BY ORDER OF THE COURT.

Petitioner's petition for writ of mandamus is denied. Although the Petitioner attached a Florida Rule of Criminal Procedure 3.850 motion dated November 15, 2007, it appears the motion was never filed in the circuit court. A certificate of nonexistence from the clerk of court has been provided to this court.
