Appeal pursuant to Fla.R.App.P. 9.140(i) from the Circuit Court for Pinellas County; Brandt C. Downey, III, Judge.


The trial court's denial, without prejudice, of John F. Curry, Jr.'s motion filed pursuant to Florida Rule of Criminal Procedure 3.850 is affirmed without prejudice for Curry to file a rule 3.850 motion containing a proper oath. See Anderson v. State, 627 So.2d 1170 (Fla. 1993).
