DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Family Court, Nassau County, dated January 9, 2013, pending hearing and determination of an appeal therefrom, and to direct her release from jail.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of the order is granted, and enforcement of the order is stayed pending hearing and determination of the appeal; and it is further,

ORDERED that the branch of the motion which is to release the appellant from jail is denied as unnecessary, as the appellant has been released.
