Jun 23, 2000
775 So. 2d 327 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D97-1646

Opinion filed June 23, 2000.

Appeal from the Circuit Court for Sarasota County; Stephen L. Dakan, Judge.

James Marion Moorman, Public Defender, and Robert D. Rosen, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Diana K. Bock, Assistant Attorney General, Tampa, for Appellee.

Dwayne Cummings appeals his convictions and sentences for armed robbery with a firearm, possession of a firearm by a convicted felon, and nine counts of armed kidnapping. The offenses occurred on April 24, 1996. We affirm the convictions without further discussion. We remand this case to the trial court, however, to reconsider the sentences. See Smith v. State, 25 Fla. L. Weekly D1273, D1274 (Fla. 2d DCA May 24, 2000).

Convictions affirmed; remanded to reconsider sentencing.

BLUE, A.C.J., and FULMER and CASANUEVA, JJ., Concur.
