FORMER ADJUDICATION, § 47when fact of absence of fraud is res adjudicata. Where petition was based on so-called findings of fraud, but the parties were the same as in a prior case in which court found a total lack of fraud in the same transaction, held that such decision finally determined, as a matter of law, said question of fraud.

Appeal from Superior Court of Cook county; Hon. JOHN C. LEWE, presiding.

Judgment affirmed. Heard in third division, first district, this court at February term, 1942.
