Cullen v. Board of Education

Supreme Court of California
Nov 28, 1932
126 Cal.App. 510 (Cal. 1932)

Opinion

          In Bank.

Application for writ of mandate prayed to be directed to the Board of Education, City and County of San Francisco, to compel reinstatement of petitioner as a teacher in evening high school. Writ granted.

          On application for hearing.

          Hearing denied.

For opinion of District Court of Appeal, see 15 P.2d 227.

Andrew F. Burke, of San Francisco, for petitioner.

John J. O'Toole, City Atty., and Walter A. Dold, Chief Deputy City Atty., both of San Francisco, for respondents.

          PER CURIAM.

The petition for hearing is denied.

In denying a hearing, however, we withhold approval from that portion of the opinion of the District Court of Appeal which holds that the two employments of petitioner constitute but one position.
