CORRECTED ORDER

PER CURIAM

On May 1, 2024, appellant filed a motion for en banc reconsideration. See Tex. R. App. P. 49.5. On May 23, 2024, appellee filed a response. We grant appellant's motion for en banc reconsideration. We vacate the majority and dissenting opinions and withdraw the judgment issued by this court on April 16, 2024. We dismiss the motion for rehearing as moot.

The court orders appellant to file a supplemental brief within 30 days from today's date. Appellee's supplemental brief is due 30 days after appellant's supplemental brief has been filed. The case will be re-submitted by oral argument to the en banc court after both supplemental briefs have been filed. The court will provide notice of argument at least 21 days in advance of argument after both supplemental briefs have been filed.

En banc court consists of Chief Justice Christopher and Justices Wise, Jewell, Bourliot, Zimmerer, Spain, Hassan, Poissant, and Wilson.

Chief Justice Christopher and Justices Wise, Jewell, and Wilson voted to deny the motion for en banc reconsideration.
