It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that defendants-respondents' motion is granted, unless plaintiff-appellant perfects his appeal by no later than the April 2013 term - the filing deadline is February 5, 2013. In the event of plaintiff-appellant's failure to comply with the foregoing condition, defendants-respondents may move on five days' notice for an order dismissing the appeal.
