We REINSTATE this appeal.

We abated this appeal for the trial court to make findings concerning appellant's counsel's failure to file appellant's brief. The brief was originally due June 17, 2023. The trial court found that counsel has not abandoned the appeal and that there was reasonable cause for counsel's delay in filing the brief. The trial court recommended granting counsel an additional 30 days to file appellant's brief. We accept the trial court's findings and recommendation.

We ORDER appellant's counsel, Mitchell R. Nolte, to file appellant's brief on or before JANUARY 2, 2024.
