ARMANDO DEL ANGEL CRUZ, Appellant, v. THE STATE OF TEXAS, Appellee.

Do not publish. Tex.R.App.P. 47.2(b).

ON APPEAL FROM THE 332ND DISTRICT COURT OF HIDALGO COUNTY, TEXAS

Before Contreras Chief Justice and Tijerina and Peña, Justices

ORDER

PER CURIAM

This cause is before the Court on appellant's fourth, fifth, and sixth motions for extension of time to file a brief. Appellant's brief was originally due on March 25, 2024. On June 27, 2024, we granted appellant's third motion for extension of time to file the brief and instructed appellant that no further extensions will be granted absent new and exigent circumstances.

Appellant's counsel provided additional exigent circumstances including being impacted by Hurricane Beryl. The Court, having fully considered the motion and previous extensions, is of the opinion that, in the interest of justice, appellant's brief should now be due by order.

Accordingly, we grant appellant's fourth, fifth, and sixth motions for extension of time to file appellant's brief. IT IS THEREFORE ORDERED that the Honorable Victoria Guerra, counsel for appellant, file appellant's brief with this Court on or before 5:00 p.m. on July 26, 2024. NO FURTHER EXTENSIONS SHALL BE GIVEN ABSENT NEW AND EXIGENT CIRCUMSTANCES. If counsel fails to file the brief, as ordered, a show cause hearing shall be set.
