THE COURT HAS ORDERED THAT the report and recommendation is adopted. The Government's motion to dismiss (dkt. 5) and the petitioner's habeas petition (dkt. 1) are granted in part and denied in part. Petitioner's request for release is denied, but the Government shall provide him with a bond hearing as ordered by the Court.
