ORDER

This matter is before the court because Appellant Earl Crownhart has failed to (1) file an entry of appearance; (2) file the opening brief; and (3) pay the $505 filing and docketing fees in the district court or return to this court a motion to proceed on appeal without prepayment of fees and costs, as previously directed by this court.

Accordingly, this appeal is dismissed for failure to prosecute and to comply with court directives. See 10th Cir. R. 3.3(B) & 42.1.

A copy of this order shall stand as and for the mandate of this court.
