On August 13, 2021, the parties in these cases filed with the Court joint Status Reports. The parties' status reports indicated that the parties have continued negotiations and discussed possible settlement of all but one central issue in each of the cases; that issue being the appropriate method for Petitioners to use to calculate depreciation on inventory related capital investments. The depreciation issue is also a central dispute in Lord v. Commissioner, Dkt. No. 19224-18 ("Lord"), which case the parties stated was submitted to this court pursuant to Rule 122 on June 2, 2021. The briefing on Lord should be completed by the end of November 2021. If no settlement is reached on the depreciation issue prior to an opinion being issued in Lord, the outcome of Lord should allow the parties to fully resolve the depreciation issue. The parties have a reasonable expectation that the above captioned cases will be settled with IRS Appeals.
With additional time, the parties believe they can either resolve the issues in these cases or narrow the issues presented to the Court for trial.
After due consideration, and for cause, it is
ORDERED that, on or before February 1, 2022, the parties shall file with the Court a joint written status report regarding the then-present status of these cases; or, if earlier, the parties shall file a joint written status report thirty (30) days after the issuance of the decision in Lord v. Commissioner, Dkt. No. 19224-18, whichever first occurs.
