On order of the Court, the motion to appear pro hac vice is GRANTED. The delayed application for leave to appeal from the April 30, 2002, decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. Plaintiff's motion to strike is GRANTED in part and DENIED in part. Defendants' Exhibit D is stricken because it is evidentiary material which is not part of the record. In all other respects the motion to strike is DENIED.
