Cross v. State

District Court of Appeal of Florida, First District
Dec 1, 1999
745 So. 2d 524 (Fla. Dist. Ct. App. 1999)

Opinion

No. 99-3549.

Opinion filed December 1, 1999.

Petition for Writ of Habeas Corpus for Belated Appeal — Original Jurisdiction.

Dale Cross, pro se, petitioner.

Robert A. Butterworth, Attorney General, Tallahassee, for respondent.

The petition for writ of habeas corpus for a belated appeal is denied. This disposition, however, is without prejudice to petitioner's right to seek relief by motion for postconviction relief in the trial court, alleging that the plea was involuntary and/or that trial counsel was ineffective in providing the advice which led to entry of the plea.

ERVIN, LAWRENCE and PADOVANO, JJ., concur.
