Opinion filed April 15, 1941.

INSURANCE, § 249representations as to health, falsity. Beneficiary could not recover on membership certificate to a funeral system association, which was in the nature of an insurance contract, where insured stated in her application that she was "in good and vigorous health," but 22 days after executing the application insured entered a hospital paralyzed from syphilis, and the immediate cause of death 5 weeks later was syphilis in its final stage.

Appeal from Municipal Court of Chicago; Hon. EUGENE J. HOLLAND, presiding.

Reversed. Heard in second division, first district, this court at February term, 1941.
