ORDER

Elizabeth A. Copeland, Judge.

This case was calendared for trial on September 13, 2021, at the Trial Session of the Court in New York, New York. This case was continued with jurisdiction retained by this Division of the Court by Order dated July 19, 2021.

On October 19, 2022, respondent filed with the Court a Motion for Summary Judgment pursuant to Rule 121. On November 14, 2022, the parties filed with the Court a Proposed Stipulated Decision resolving all remaining issues in this case, therefore the Motion for Summary Judgment is moot.

Upon due consideration, and for cause, it is

ORDERED that respondent's Motion for Summary Judgment, filed with the Court October 19, 2022, is denied as moot.
