MEMORANDUM OPINION


By order dated January 13, 2009, the Court referred the above appeal to mediation. On March 23, 2009, we received correspondence from the mediator stating the parties have settled. By letter dated April 21, 2009, we directed the parties to file a motion to dismiss the appeal within ten days. We further warned that if no motion was filed, we would, without further notice, dismiss the appeal. To date, we have received neither a motion to dismiss nor any other correspondence related to the appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 42.3(c).
