ORDER
The reporter's record was due January 2, 2018, but was not filed. On January 10, 2018, Maria Vargas, one of the court reporters responsible for the record, filed a notification of late record, stating that her portion of the record had not been filed because appellant had not paid or made arrangements to pay the reporter's fee to prepare the record and that appellant is not entitled to the record without paying the fee. See TEX. R. APP. P. 34.6(b), 35.3(b). On January 23, 2018, we ordered appellant to provide written proof to this court that either: (1) Ms. Vargas's fee had been paid or arrangements satisfactory to her had been made to pay the reporter's fee; or (2) appellant was entitled to the record without prepayment of the reporter's fee. See id. R. 35.3(b). In response, appellant filed a response, stating he contacted Ms. Vargas regarding payment and Ms. Vargas indicated another court reporter, Tracy Ray Plummer, took the record. Attached to his response, Appellant provided an email confirmation from Ms. Plummer, indicating she has received payment for the record.
Accordingly, we ORDER the court reporter, Tracy Ray Plummer, to file her portion of the reporter's record in this court on or before March 9, 2018.
We order the clerk of this court to serve a copy of this order on all counsel and the court reporter, Tracy Ray Plummer.
