ORDER

This matter is before the court on the parties' Stipulation to Dismiss, with each party to bear his or her own costs on appeal.

Upon consideration, the court construes the parties' stipulation as a motion to voluntarily dismiss this appeal pursuant to Rule 42(b) of the Federal Rules of Appellate Procedure. Upon consideration, the court grants the motion as construed and dismisses this appeal, each party to bear his or her own costs on appeal. See Fed. R. App. P. 42(b); 10th Cir. R. 46.3(C).

A copy of this order shall stand as and for the mandate of the court.
