694 So. 2d 781 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-01545

Opinion filed May 2, 1997. Rehearing Denied June 9, 1997.

Appeal from the Circuit Court for Pasco County; W. Lowell Bray, Jr., Judge.

Cynthia Byrne Hall and Mark V. Silverio of Silverio Hall, Miami, for Appellants/Cross Appellees.

William Rambaum of William Rambaum, Clearwater, for Appellees/Cross Appellants.

After the trial court in this case dismissed the action for lack of prosecution, the appellees moved to assess fees under an offer of judgment made pursuant to section 768.79, Florida Statutes (1993), and on other grounds.

This court has reversed the order of dismissal. That reversal requires reversal on this appeal of the order awarding attorney's fees.

Reversed.

LAZZARA and WHATLEY, JJ., Concur.
