Heeding first, then, the separate defenses, it is noted that the defendants initially aver that the plaintiff is prohibited from prosecuting the present action against the defendants by the decree barring: creditors in that the plaintiff failed to present its alleged claim to the executors within the time designated by the order to limit creditors. R.S.1937, 3:25-9, 3:25-10, 3 Comp.St.1910, p. 3835, § 70. Cranmer v. Cole, 167 A. 744, 11 N.J.Misc. 578. It is to be observed that section 70 of the Orphans' Court Act, R.S.1937, 3:25-9, 3:25-10, 3 Comp.St.1910, p. 3835, § 70, states that the neglectful creditor "shall, by such decree, be forever barred of his or her action therefor against such executor or administrator, except as hereafter provided."
