JUDGMENT


In accordance with the order entered on this date, it is hereby ORDERED, ADJUDGED, and DECREED that the petition for writ of habeas corpus be DENIED on the basis that this Court is precluded from conducting post-conviction review of Fourth Amendment claims where, as here, Alabama's state courts have provided an opportunity for full and fair litigation of those claims.

DONE.

ORDER

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and a de novo determination of those portions of the recommendation to which objection is made, the recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(B) and dated August 10, 2000, is ADOPTED as the opinion of this Court.
