The clerk's record is incomplete because it does not include the trial court's certification of defendant's right of appeal. The trial court's docket sheet entry of September 26, 2023 states the trial court signed "Defendant's Right of Appeal." On November 13, 2023, this Court ordered the Dallas County District Clerk to file a supplemental clerk's record containing the trial court's certification of defendant's right of appeal. However, on December 1, 2023, the district clerk filed a letter with this Court stating that the district clerk has not received the documents "pertaining to the defendant right of appeal."
Accordingly, we ORDER the Honorable Raquel Jones, Presiding Judge, 203rd Judicial District Court, to transmit to the district clerk within TEN DAYS of the date of this order, a signed trial court's certification of defendant's right of appeal that accurately reflects the trial court proceedings and the defendant's right of appeal. We ORDER Felicia Pitre, Dallas County District Clerk, to file a supplemental clerk's record containing the trial court's certification of defendant's right of appeal within THIRTY DAYS of the date of this order.
We DIRECT the Clerk to send copies of this order to the Honorable Raquel Jones, Presiding Judge, 203rd Judicial District Court; Felicia Pitre, Dallas County District Clerk; Christina O'Neil, Chief Judicial Staff Counsel for the Criminal District Courts, Dallas County; and counsel for all parties.
