ORDER


After making the review required by 28 U.S.C. § 636(b), the Court finds that the Findings, Conclusions and Recommendation of the Magistrate Judge are correct, and they are adopted as the findings and conclusions of the Court.

IT IS THEREFORE ORDERED that Plaintiff's motion for leave to proceed in forma pauperis, filed on January 31, 2005, is DENIED pursuant to the three-strike provision of 28 U.S.C. § 1915(g), and that his motion to change the spelling of his last name, filed on February 22, 2005, is DENIED.

IT IS FURTHER ORDERED that this action will be dismissed as barred by the three-strike provision unless Plaintiff tenders the $150.00 filing fee within 30 days of this order.

The Clerk shall transmit a copy of this order to Plaintiff.
