ORDER AFFIRMING AND ADOPTING RECOMMENDATION OF MAGISTRATE JUDGE
THIS MATTER comes before the Court on Plaintiff Gary R. Cozzolino, Jr.'s pro se Complaint filed September 24, 2002. After the Plaintiff failed to appear or contact the Court in connection with the June 24, 2003, preliminary scheduling conference, United States Magistrate Judge Boyd N. Boland issued an Order to Show Cause on June 24, 2003, as to why this action should not be dismissed for lack of prosecution and failure to comply with court orders. See D.C.COLO.LCivR 41.1. The Plaintiff did not respond to Magistrate Judge Boland's Order. On July 14, 2003, Magistrate Judge Boland recommended that this case be dismissed without prejudice pursuant to D.C.COLO.LCivR 41.1; that recommendation is incorporated herein by reference. See 28 U.S.C. § 636(b), FED. R. Civ. P. 72. Plaintiff did not file objections to Magistrate Judge Boland's Recommendation.
No objections having been filed, I review the Recommendation to "satisfy [my]self that there is no clear error on the face of the record." FED. R. Civ. P. 72(b) advisory committee's notes. Having reviewed the recommendation, I am satisfied that there is no clear error on the face of the record. Accordingly, it is hereby
ORDERED that United States Magistrate Judge Boyd N. Boland's Recommendation filed July 14, 2003, is AFFIRMED and ADOPTED. It is
FURTHER ORDERED that this case is DISMISSED WITHOUT PREJUDICE pursuant to D.C.COLO.LCivR 41.1.
