Cox v. State

District Court of Appeal of Florida, Second District
Apr 22, 1994
635 So. 2d 153 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-03548.

April 22, 1994.

Appeal from the Circuit Court for Manatee County; Peter A. Dubensky, Judge.

Barbara C. Davis and Flem K. Whited, III, Law Office of Flem K. Whited, III, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Davis G. Anderson, Jr., Asst. Atty. Gen., Tampa, for appellee.

Willoughby Turner Cox appeals the new sentence imposed by the trial court. The state concedes that the resentencing is erroneous in light of the supreme court's ruling in Felty v. State, 630 So.2d 1092 (Fla. 1994). We reverse and remand for resentencing.

DANAHY, A.C.J., and PARKER and LAZZARA, JJ., concur.
