FINAL JUDGMENT


This lawsuit was tried to the court sitting without a jury. Having studied the evidence, the court is persuaded to find for certain of the plaintiffs and against the defendant. The opinion of this court dated June 18, 2004, and the findings of fact and law included therein are incorporated by reference. For the reasons assigned in that opinion, the court concludes that judgment should be entered in favor of certain of the plaintiffs and against the defendant and that those plaintiffs should be awarded their costs of litigation.

IT IS FURTHER ORDERED AND ADJUDGED that those plaintiffs are entitled to recover their taxable costs in this action upon filing a Bill of Costs in the time and manner prescribed in accordance with the local rules.

IT IS FURTHER ORDERED AND ADJUDGED that pursuant to § 1988 of Title 42 U.S.C., plaintiffs' counsel is entitled to attorney fees upon submitting a proper motion for same.

SO ORDERED AND ADJUDGED.
