Cowart v. Dixie Lime

District Court of Appeal of Florida, Fifth District
Oct 30, 1998
719 So. 2d 1009 (Fla. Dist. Ct. App. 1998)

Opinion

No. 98-705.

October 30, 1998.

Appeal from the Circuit Court for Sumter County; Hale R. Standi, Judge.

Scott A. Frick of Ayers, Cluster, Curry, McCall Briggs, P.A., Ocala, for Appellants.

James M. Spoonhour and John T. Wettach, Jr., of Lowndes, Drosdick, Doster, Kantor and Reed, P.A., Orlando, for Appellee.

This is an appeal from two orders of default entered against appellant for failure to answer timely the complaints filed against them by appellees. Because the record demonstrates the clerk's defaults were nullities and the answers were filed before the court's defaults were rendered, the answers were filed timely.

ORDERS QUASHED; REMANDED.

DAUKSCH, W. SHARP and HARRIS, JJ., concur.
