On January 6, 2023, docket entry 10, respondent filed with the Court a Motion to Dismiss for Failure to Properly Prosecute.

This case was called from the calendar at the remote Birmingham, Alabama Trial Session of the Court on January 30, 2023. By Order dated February 1, 2023, docket entry 16, the Court took respondent's Motion to Dismiss for Failure to Properly Prosecute under advisement.

On March 15, 2023, docket entry 17, the parties submitted a Proposed Stipulated Decision document which the Court accepted and entered on March 17, 2023, docket entry 18. Therefore, the Court will deny as moot respondent's Motion to Dismiss for Failure to Properly Prosecute, filed January 6, 2023, docket entry 10.

After due consideration, and for cause, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed January 6, 2023, docket entry 10, is denied as moot.
