Before the Court is respondent's Motion to Dismiss for Failure to Properly Prosecute, filed January 6, 2023, docket entry 10.

This case was called from the calendar at the remote Birmingham, Alabama Trial Session of the Court on January 30, 2023. The parties appeared and were heard. During the Trial Session, the parties were able to discuss this case; a Low-Income Tax Clinic representative was able to assist the petitioner. This case was recalled an additional three times later on during the day.

After due consideration, and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that jurisdiction of this case is retained by this Division of the Court until further notice. It is further

ORDERED that this case is continued. It is further

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed January 6, 2023, docket entry 10, is taken under advisement. It is further

ORDERED that, on or before March 16, 2023, the parties shall submit a Proposed Stipulated Decision document or file a Joint Status Report with the Court as to the then-present status of this case.
