ORDER


Before the Court is Magistrate Judge Nancy K. Johnson's Memorandum and Recommendation (MR) entered June 27, 2003 (Dkt. #33). The MR is ripe for consideration because neither party filed objections before the expiration of the response period. After considering the MR, the entire record and the applicable law, the Court ADOPTS the MR.

See R. CIV. P. 72(b) (a party may file objections to a magistrate judge's proposed findings and recommendation on a dispositive motion within ten days of service); see also 28 U.S.C. § 636(b)(1).
