This case is currently calendared on the Court's Seattle, Washington trial session, scheduled to begin February 12, 2024.

On December 14, 2023, the Commissioner filed a motion for summary judgment. The Court thereafter issued an Order directing petitioner Paul Counts to file a response to the motion for summary judgment by January 16, 2024. Mr. Counts did not file a response. We will give Mr. Counts an opportunity to appear at the above-referenced trial session to be heard on the motion for summary judgment. Upon due consideration, it is

ORDERED that the Commissioner's motion for summary judgment is set for hearing at the calendar call of the Court's Seattle, Washington trial session, scheduled to begin at 10:00 a.m., on February 12, 2024, in Room 4, 3rd Floor, at the Nakamura U.S. Courthouse, 1010 5th Avenue, Seattle, Washington 98104. If Mr. Counts does not appear at the hearing, the Court may grant the motion for summary judgment and enter a decision against him.
