ORDERED that Congressman Cass Ballenger is dismissed from the case, and the United States of America is substituted as the nominal defendant in this action; and it is further

ORDERED that defendant's Motion to Dismiss [#9] is GRANTED, and it is further

ORDERED that judgment is entered in favor of the defendant, and the case is dismissed with prejudice.
