ORDER ADOPTING REPORT AND RECOMMENDATION

The magistrate judge to whom this matter was referred has issued a Report and Recommendation (dkt. no. 26) (“R & R”) recommending that the defendants' Motion to Dismiss (dkt no. 20) be granted in part and denied in part. Plaintiffs and Defendants each filed limited objections to the R & R. Defendants then filed a response to the plaintiffs' objections.
Having reviewed the relevant pleadings and submissions, I concur with the magistrate judge's proposed rulings and overrule the parties' objections. The R & R is supported by detailed analysis of the factual record and careful application of precedent. Therefore, the motion to dismiss is DENIED as to Counts I-III and is GRANTED as to Counts IV-X.
