IN THE MATTER OF COUNTY OF ONONDAGA AND ONONDAGA COUNTY BAR ASSOCIATION ASSIGNED COUNSEL PROGRAM, INC., PETITIONERS, v. HON. JOHN J. BRUNETTI, JUDGE COURT OF CLAIMS, ACTING JUSTICE SUPREME COURT, AND HON. JOSEPH E. FAHEY, JUDGE OF CRIMINAL COURT, RESPONDENTS.


PRESENT: , P.J., PERADOTTO, CARNI, WHALEN, AND MARTOCHE, JJ.

Petitioners having moved for leave to amend the petition to join Christina Cagnina as an additional party to this CPLR article 78 proceeding,

Now, upon reading and filing the affidavits of Jonathan B. Fellows, Esq., sworn to November 26, 2012, and December 3, 2012, the notice of motion with proof of service thereof, the affirmation of Victor Paladino, Esq., dated November 29, 2012, and the affidavit of Christina G. Cagnia, Esq., sworn to December 7, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and that Christina Cagnina be joined in the above-entitled proceeding as a party respondent, and

It is further ORDERED that on or before April 4, 2013, petitioners shall serve upon Christina Cagnina and all other respondents a notice of amended petition and the amended petition, and

It is further ORDERED that on or before April 4, 2013, the petitioners shall serve upon Christina Cagnina their petitioners' brief, together with all other papers filed and served in this proceeding, and

It is further ORDERED that on or before April 11, 2013, petitioners shall file with this Court proof of service of the aforementioned papers and an original and 10 copies of the notice of amended petition and amended petition, and

It is further ORDERED that Christina Cagnina and the other respondents shall file and serve an answer to the amended petition not more than 30 days after service of the notice of amended petition and amended petition, and

It is further ORDERED that this proceeding shall be added to the Court's calendar for the term commencing June 17, 2013, this proceeding shall be deemed submitted, and no oral argument shall be permitted.
